AFFIDAVIT OF ELIGIBILITY, CONSENT AND RELEASE AND RECEIPT OF PRIZE MARIAH CAREY’S MOTHER’S DAY TWEETSTAKES ON TWITTER SWEEPSTAKES

SWEEPSTAKES: The MARIAH CAREY’S MOTHER’S DAY TWEETSTAKES (“Sweepstakes”).

ELIGIBILITY: The signature below certifies that the undersigned: (i) is not an employee of Elizabeth Arden, Inc. or any participating retailer(s), prize providers/ suppliers or sponsor(s) and is not immediately related to any such employee; (ii) was not required to make a purchase in order to participate in the Sweepstakes; (iii) is 18 years of age or older; and (iv) is a resident of the 50 United States or the District of Columbia.

CONSENT: The undersigned acknowledges, confirms and reaffirms that entry into the Sweepstakes constituted the undersigned’s consent to the use of the undersigned’s name, likeness, biographical data and/or user generated content for advertising, promotion and publicity purposes by Elizabeth Arden, Inc. or its designees without any further consent from any party or compensation to or in respect of any party..

RELEASE: The undersigned and any other person or entity who may assert any claim through or on behalf of the undersigned, hereby releases and discharges Elizabeth Arden, Inc., participating retailer(s), prize providers/suppliers and any sponsor(s) of the Sweepstakes and each of their respective affiliates (including any parent entity, subsidiary, division or other related company), officers, directors, employees, agents, licensees, successors and assigns from any and all claims, demands, expenses (including reasonable counsel fees), causes of, action and liabilities, whether for bodily injury (including injuries suffered during travel to, at or in connection with the Sweepstakes), property damage, incidental or consequential damages, violation of any right of privacy, publicity, copyright or any other matter (each a “Claim”) as may arise out of or relate to participation in the Sweepstakes, including any caused directly or indirectly by the undersigned, Elizabeth Arden, Inc., prize providers/suppliers or any sponsors, including use of any prize identified in this Affidavit (the “Prize”) and any publicity in connection therewith.

PRIZE: The winner will receive one (1) Mariah Carey Forever Eau de Parfum Spray, 3.3 fl. oz. (ARV of $65.00) and one (1) copy of Mariah Carey’s The Essential album (ARV of $13.98).

This Affidavit affirms that the undersigned has been awarded the “Prize” and the undersigned hereby acknowledges that the Prize is not transferable, refundable, will not be substituted for or replaced by an alternate prize and is not exchangeable or returnable.

TAXES: The undersigned hereby agrees to be solely responsible for all taxes assessed or payable in respect of the Prize, if any. The undersigned has been advised and acknowledges that in the event that a person does not comply with the Official Rules including timely return of the signed original of this Affidavit, the non-complying person will be disqualified and will forfeit the Prize which will be awarded to an alternate winner.

Whereupon, the undersigned has agreed to the above and has signified such agreement by completing and executing the following certification.
